In Derek Chauvin’s case, Attorney Eric Nelson claims “prosecutorial and jury misconduct”, as well as “errors of law at trial; and a verdict that is contrary to law.”

Defense attorney filed motions to seek new trial

The motion comes after controversial photos emerged showing one of the jurors, Brandon Mitchell, attended a rally in Washington, DC, where he appeared to be wearing a T-shirt with the words “Get your knee off our necks.”

Chauvin’s legal team argues that the jury should have been sequestered for the duration of the trial, or in the least, admonish them to avoid all media, which resulted in jury exposure to prejudicial publicity regarding the trial during the proceedings, as well as jury intimidation and potential fear of retribution among jurors, which violated
Chauvin’s constitutional rights to due process and to a fair trial.
